Public prosecutors have indicted 19 red shirt leaders and supporters on terrorism and other charges stemming from their street protests from late February to mid-May.
The indictment was issued at the Criminal Court yesterday on the last day the suspects could be held legally in detention.
They were held for 84 days after being charged by the Department of Special Investigation (DSI) in relation to the protests in which 91 people were killed and nearly 2,000 were injured.
The court accepted the indictment and set Monday for a preliminary hearing.
The 19 are Veera Musikhapong, Jatuporn Prompan, Natthawut Saikua, Weng Tojirakarn, Korkaew Pikulthong, Khwanchai Praipana, Yoswaris Chuklom, Nisit Sinthuprai, Karun Hosakul, Wiphuthalaeng Patanaphumthai, Phumkitti Sujindathong, Suksek Poltue, Jaran Loypul, Amnat Inthachote, Chayut Laicharoen, Sombat Makthong, Surachai Thewarat, Rachot Wongyod and Yongyuth Thuammee.
They were charged with terrorism, instigating legal violations, causing unrest and staging illegal gatherings from Feb 28 to May 20, prosecutors said.
Public prosecutors have prepared a similar indictment against their putative leader, former prime minister Thaksin Shinawatra, Pol Lt Col Waipote Apornrat, Arisman Pongruengrong, Adisorn Piangket, Suporn Atthawong and Payap Panket. All are at large and prosecutors are working with the DSI to go after them.
A 26th suspect, Maj Gen Khattiya Sawasdipol, was shot and killed in the course of the protests.
United Front for Democracy against Dictatorship (UDD) lawyer Karom Polthaklang said the charges were politically motivated and all 19 accused were innocent. He will provide the court on Monday with a list of more witnesses and evidence to support his case
The investigation was hastily conducted by police and public prosecutors, Mr Karom said yesterday.
This was very different to the case being made against the People’s Alliance for Democracy for occupying the city’s airports in 2008. Police have charged 79 PAD leaders and supporters in relation to the seizure of the airports but they have refused to report to police to answer the charges after several postponements. The next appointment is set for Aug 29.
The indictment of the 19 red shirts, who are either UDD leaders or guards, states they instigated the red shirt protests and demanded that the prime minister dissolve the House of Representatives to pave the way for a new general election.
The defendants are also accused of staging protests involving tens of thousands on Ratchadamnoen Avenue and at the Ratchaprasong intersection, and of laying siege to several places including the office of the Election Commission, parliament, the 22nd Infantry Regiment and the prime minister’s home.
They are further accused of launching grenade attacks on people’s homes, the Defence and Public Health ministries, the Legal Execution Department, the Gen Prem Tinsulanonda Foundation, Government House and branches of Bangkok Bank.
The indictment states the accused and their accomplices fired on government forces and torched state and private properties on May 19 and 20 after troops moved in to crush their protest.
Mr Jatuporn, a Puea Thai Party list MP, said public prosecutors were acting on the orders of politicians.
He said he would stage a protest at the Office of the Attorney-General to demand that the attorney-general be sacked for not being neutral.
Mr Jatuporn also attacked Justice Minister Pirapan Salirathavibhaga for putting pressure on the OAG to speed up the indictments.
The government imposed an emergency decree on April 7 in response to the red shirt rallies. It remains in effect in 10 provinces including Bangkok.
Prime Minister Abhisit Vejjajiva said yesterday the emergency decree would be lifted next Monday in some provinces which are tourist destinations.bron:Bangkokpost

Red shirt supporters in the North are gearing up for mass gatherings after Prime Minister Abhisit Vejjajiva lifted the state of emergency decree in three provinces.
Suthep: Says PM was worried about impact
Mr Abhisit yesterday told cabinet he had lifted the emergency decree in Chiang Mai, Chiang Rai and Ubon Ratchathani following a recommendation from the Centre for the Resolution of the Emergency Situation (CRES).
The decree remains in effect in seven provinces: Bangkok, Nonthaburi, Pathum Thani, Samut Prakan, Udon Thani, Khon Kaen and Nakhon Ratchasima.
Mr Abhisit said security forces in the provinces where the decree had been lifted might enforce other laws on the books to prevent activities that could lead to unrest.
The state of emergency decree was imposed in 24 provinces in April when the United Front for Democracy against Dictatorship (UDD) began staging its mass protest in Bangkok. It has since been lifted in 17 provinces.
Mr Abhisit denied opposition Puea Thai Party claims that the government planned to enforce the decree for more than one year in certain areas.
The government has based its decision on the decree’s scope on an assessment of each area and has lifted it in areas where the situation had returned to normal, he said.
Deputy Prime Minister and CRES director Suthep Thaugsuban said the prime minister decided to lift the decree in the three provinces as he was concerned about its impact on businesses and the tourism industry.
Red shirt supporters in Chiang Mai have been buoyed by the revocation of the decree. Phichit Tamoon, a UDD leader in Chiang Mai, said the group would hold its first gathering on Sunday near Tha Phae gate in Muang district.
Puea Thai chief MP Chalerm Yubamrung said the party’s key members would visit supporters in Chiang Mai, Chiang Rai and Phayao.
Jatuporn Prompan, a UDD leader and a Puea Thai list MP, said the UDD would rush to offer assistance to red shirt supporters in the three provinces who had been adversely affected during the army dispersal of the Bangkok demonstration in May.
Meanwhile, 17 of the 19 UDD leaders charged with terrorism yesterday denied all counts during the first hearing of the case in the Criminal Court.
Veera Musikhapong, 62, the only UDD leader allowed free on bail, and 16 other detained red shirt chiefs attended the hearing at the Criminal Court on Ratchadaphisek Road yesterday morning.
Also accused are Puea Thai MPs Jatuporn Prompan, 44, and Karun Hosakul, 42, who are protected by parliamentary immunity and did not attend yesterday’s hearing.
The court will review the defendants’ witness list and evidence on Sept 27.
The state of emergency will be lifted last in Bangkok, National Security Council secretary-general Thawil Pliensri on Tuesday.
Mr Thawil said this decision was reached only after careful deliberation.
Prime Minister Abhisit Vejjajiva and Deputy Prime Minister Suthep Thaugsuban, who is also director of the Centre for the Resolution of the Emergency Situation, had repeatedly expressed concern over the situation in Bangkok.
The emergency decree is currently still in force in Bangkok, Nonthaburi, Pathumthani, Samut Prakan, Udon Thani, Khon Kaen and Nakhon Ratchasima.
He said the NSC would assess the situation and gradually propose lifting the decree in these provinces, but Bangkok would certainly be the last.
Members of the anti-government United Front for Democracy against Dictatorship were still active and holding meetings, but the situation was generally under control, Mr Thawil said.
Asked about fugitive former prime minister Thaksin Shinawatra, the NSC chief said he had been quiet for some time for an unknown reason, but this had helped improved the overall situation.
Chiang Mai provincial secretary Surachai Jongrak said the situation in the northern province remains quiet after the lifting of the state of emergency on Monday, and everything is under control.
This was the conclusion of a meeting of security agencies in the province.
Mr Surachai said that in order to restore the city’s image and a friendly atmosphere, barbed wire and concrete blocks placed around the city hall have been removed. The city hall is now under normal security procedures.
He was optimistic the new atmosphere would help boost Chiang Mai’s depressed tourism industry

Police suspect a grenade attack at state-run Channel 11 station was the work of the same people behind last week’s explosion at the King Power Complex on Rang Nam Road.
Pol Gen Panupong Singhara na Ayutthaya, an adviser to the Royal Thai Police and chief investigator on the case. said initial inquiries into yesterday’s attack on the station suggest a link to last Thursday’s explosion at King Power, which left a security guard in critical condition.
A grenade landed in the car park of the station on Vibhavadi Rangsit Road about 1.30pm.
It was the third time the station has been targeted this year after attacks on March 27 and April 4.
The grenade reportedly landed about five metres inside the entrance gate to the car park and detonated after hitting a tree.
Four cars were damaged but there were no reports of injuries.
Investigators believe the grenade was fired from an M79 launcher from the nearby elevated tollway.
Pol Gen Panupan said his team was reviewing footage from surveillance cameras on the tollway.
The incident was the latest in a string of bomb and grenade attacks across the capital that have taken place despite the emergency decree being in place.
A bomb hidden near a bus stop in front of Big C Ratchadamri exploded on July 25, killing one person.
Pol Gen Panupong said more checkpoints would be set up in the capital as a security measure.
His comments also follow reports suggesting that the underground railway and shopping malls could be targeted for attack.
The Centre for the Resolution of the Emergency Situation (CRES) said yesterday the attack on Channel 11 was aimed at inciting disorder.
CRES spokesman Sansern Kaewkamnerd said the centre’s director, Deputy Prime Minister Suthep Thaugsuban, had instructed authorities to intensify intelligence operations.
Col Sansern said 11 spots had been identified as vulnerable to attack and police had been told to step up security measures.
He said security would be tightened at Channel 11, army-owned Channel 5 and public transport stations.
Meanwhile, the Thai Journalists Association and the Thai Broadcasting Journalism Organisation yesterday denounced the attack on Channel 11 in a joint statement.

The Centre for the Resolution of the Emergency Situation (CRES) has resolved to step up security measures by keeping 464 spots in the capital prone to attack under watch round the clock, Pol Maj-Gen Piya Uthayo said on Friday.
Pol Maj-Gen Piya, the metropolitan police spokesman, said personnel to be deployed for security will be drawn from the 1st Army Region, Metropolitan Police Bureau and the Bangkok Metropolitan Administration.
Under a special operational plan adopted by the CRES, the 464 spots are grouped in three security levels. They are:
130 spots on full-scale alert. They include royal palaces, houses of important persons, and transport terminals. Security units will be in position within a 400-metre radius from these spots 24 hours a day. They will be supported by foot patrols and surveillance teams.
198 spots on high alert. They include government installations and offices, houses of important persons, and possible targets for symbolic attacks. More checkpoints will be set up near these spots.
136 spots for frequent security checks. They include department stores, banks and crowded areas.
The CRES has also prepared 10 special operations units on call to be dispatched to various spots in an emergency.
BMA’s closed-circuit cameras will be checked and repaired to make sure they work properly. The CRES has also received cooperation from the private sector to examine the footage of their CCTV cameras.
Representatives of the 1st Army Region, BMA, Metropolitan Police Divisions 1-9, which will take part in security operations, were to attend a meeting at the CRES headquarters on Friday afternoon to be briefed on the operation plan, Pol Maj-Gen Piya said.Bangkokpost

The government will not re-enact the emergency decree in Chiang Mai even though five grenades from M79 launcher were fired into Khun Nen army camp in the northern province’s Mae Rim district on Thursday, Deputy Prime Minister Suthep Thaugsuban said on Saturday.
Mr Suthep, who is in charge of security affairs, said he has not yet received report on the bombings at the military camp in Chiang Mai.
Asked about the planned rallies by the United front for Democracy against Dictatorship on September 19, Mr Suthep said police have come up with operation plans to deal with the red-shirts.

The activities yesterday, led by Sombat Boonngam-anong, of the Red Sunday group, were a prelude to this coming weekend’s events to mark the fourth anniversary of the 2006 coup d’etat.
The protesters yesterday held a bicycle parade around the demonstration sites _ starting from Ratchaprasong intersection to Victory Monument, Din Daeng and finishing at the King Rama VI monument at Lumpini Park.
The Red Sunday group has held events in the Ratchaprasong area each Sunday since June to remind the public about the violence and to defy the government’s ban on political gatherings of more than five people under the emergency decree, which is still in effect in Bangkok and six other provinces.
About 100 people taking part in the bicycle parade stopped at spots where red shirt supporters were reportedly killed to pay their respects.
“People need such kinds of peaceful and safe activities to join and to share their feelings,” Mr Sombat said.
He expected more people to join the activities next Sunday, when a big event will be held at Ratchaprasong intersection to pay respect to those killed in the April 10 clash between government forces and protesters at the Khok Wua intersection and the May 19 dispersal of red shirt protesters from Ratchaprasong.
The gathering will also mark the fourth anniversary of the Sept 19 coup that toppled the Thaksin Shinawatra government.
“We will gather peacefully to recall the democracy which has disappeared from the country since the 2006 putsch,” Mr Sombat said. “We will also seek justice for those killed.”
He said the event would start at 5pm when participants would release about 10,000 red balloons attached with written messages from red shirt supporters and some 100,000 red ribbons would be tied around trees, bus stops and sign poles around the Ratchaprasong area.
Street performances and plays would also be held throughout the event.
Red shirt members in provinces such as Chiang Mai and Ubon Ratchathani, and overseas, would also hold symbolic activities in remembrance of the incidents, Mr Sombat said.
He assured the activities would be peaceful and would not cause trouble to the public.
“There will be no road blocks. All activities will be held on the pavement,” he said.
Mr Sombat said Prime Minister Abhisit Vejjajiva had created “a good atmosphere” by saying during his weekly television address yesterday that symbolic activities that did not cause the public any trouble were acceptable.
Khattiyaa Sawasdipol, the only daughter of the late Maj Gen Khattiya Sawasdipol, known as Seh Daeng, also took part in yesterday’s event.
“Four months have passed and the Department of Special Investigation has made very slow progress in an investigation into the death of my father and the other 90 people who died in the April-May violence,” Ms Khattiyaa said.
Pornthip Mankong, a Ramkhamhaeng University student who dressed as a ghost in a performance at the King Rama VI monument, said she and her friends wanted to remind the public that there were many people killed at the site.
“Spirits of the red shirt people are still here to seek justice,” she said.

The Centre for the Resolution of the Emergency Situation (CRES) has set up a command post to monitor the activities of the red-shirts to mark the fourth anniversary of the Sept 19, 2006 coup during the weekend, spokesman Col Sansern Kaewkamnerd said after a CRES meeting on Friday.
The CRES command post is supervised by army chief Gen Anupong Paojinda but has responsibility only for the seven provinces still under the emergency decree – Bangkok, Nonthaburi, Pathum Thani, Samut Prakan, Udon Thani, Khon Kaen and Nakhon Ratchasima.
In other provinces, the situation will be monitored by staff of the Internal Security Operations Command.
Asked about a report that military weapons were found to be missing in Lop Buri, the CRES spokesman said the appropriate agencies had been ordered to check if it was true.
Pol Col Songpol Watthanachai, deputy spokesman of the metropolitan police, said police had made preparations to cope with any situation in Bangkok and Chiang Mai during the rallies on Sunday.
Emphasis would be given to security checkpoints and patrols, he said.
On reports of possible attacks on important people, he said police chief Pol Gen Wichean Potephosree had ordered intelligence units to be more vigilant.
Col Sansern said the CRES meeting on Friday also discussed preparations to give information to a subcommittee investigating the death of 89 people during the April-May street protests. The subcommiteee is scheduled to visit the CRES on Tuesday, Sept 21.
In the morning, hundreds of members of the United front for Democracy against Dictatorship (UDD) defied a state of emergency in Bangkok to lay roses at the gate of the Bangkok Remand Prison tand call for the release of their leaders and colleagues who were arrested during anti-government protests in May.
The rally was led by red-shirt leader and Puea Thai list MP Jatuporn Prompan, who told the crowd to gather again at the prison next week.
He said the UDD would continue weekly red-rose laying activities at all prisons where red-shirts are being held, until they are freed.
Five companies of metropolitan police were deployed at the prison to ensure law and order.
Red-shirts in other provinces held similar gatherings, including Nan, Mahasarakam, Uttaradit, Udon Thani and Ubon Ratchathani.
In Lampang, about 300 red-shirts laid red roses at the fence of the provincial prison and read out their statement calling for the release of all political prisoners held since the Sept 19, 2006 coup. They dispersed peacefully afterwards.
Meanwhile, the opposition Puea Thai Party will hold a panel discussion to mark the fourth anniversary of the coup at the party head office on Sunday, Kuthep Sai-krachang said.
Mr Kuthep, a former spokesman of the dissolved People Power party, said the discussion - Four years after the coup, what has Thailand got? - will begin at 2pm.
Panelists will include former prime minister Somchai Wongsawat, Chaturon Chaisaeng, former acting leader of the dissolved Thai Rak Thai Party, and Kanin Boonsuwan, a former constitution drafting assembly member.

A “war room” will closely monitor the situation around the country as the red shirts hold rallies this weekend.
The Centre for the Resolution of the Emergency Situation (CRES) has set up a command centre headed by army commander Anupong Paojinda.
It has also set up centres in provinces where the emergency decree remains in effect to help with surveillance. Apart from Bangkok, the decree is still imposed in Nonthaburi, Samut Prakan, Pathum Thani, Nakhon Ratchasima, Khon Kaen and Udon Thani.
Security officers have set up checkpoints and organised patrols. They claim there have been intelligence reports that some parties may try to create unrest.
The CRES also took into account red shirt protesters’ planned activities in Chiang Mai today. It put 11 companies of police and soldiers on standby to maintain order there.
Meanwhile, protesters have vowed they will keep on laying red roses in front of prisons until their detained leaders are released.
Puea Thai Party MP and red shirt leader Jatuporn Prompan led about 1,000 supporters to Bangkok Remand Prison yesterday morning to put up red roses on its gates.
Mr Jatuporn said the red shirts did not mean to pressure the court but would continue to make the gesture until its leaders were freed.
Red shirt leaders, including Natthawut Saikua and Weng Tojirakan, have been detained pending prosecution on many charges, including terrorism, following anti-government protests that developed into arson and riots in April and May.
According to Mr Jatuporn, protesters will resume their rose-laying activities next week. They will also stage a rally in Chiang Mai province tomorrow.
He emphasised the gatherings will be peaceful and the protesters will disperse after completing their activities.
Surachet Chaikosol, Puea Thai MP for Ayutthaya, said a convoy of red shirts will leave Bangkok for Chiang Mai today. They will stop over in Ayutthaya, where locals are expected to give them food supplies and moral support.
Mr Surachet said the government was trying in vain to stop the movements of protesters.
CRES spokesman Sansern Kaewkamnerd thanked red shirt protesters for their peaceful activities yesterday.
Apart from the rally in front of Bangkok Remand Prison, red shirts conducted similar rose-placing activities at prisons in other provinces.
Their numbers ranged from 30 to 100 in each province, he said.
Col Sansern said the CRES is preparing information to provide to a sub-committee of the Truth and Reconciliation Committee on the 89 people who were killed during the violence in April and May in Bangkok.
He said that not all of them were killed on May 19. The sub-committee will visit the CRES on Tuesday.
Meanwhile, the CRES has issued an announcement prohibiting protesters from using loudspeakers.

Red-shirt supporters of the anti-government United Front for Democracy against Dictatorship (UDD) in Bangkok gathered on Sunday morning to mark the fourth anniversary of the September 19, 2006 coup and the political violence in Ratchaprasong four months ago.
Red-shirt supporters of the anti-government United Front for Democracy against Dictatorship (UDD) in Bangkok gathered on Sunday morning to mark the fourth anniversary of the September 19, 2006 coup and the political violence in Ratchaprasong four months ago.
Reports said a group of red-shirts travelled to Pathum Wanaram temple and placed red roses outside the pavilion where some protesters were killed during the rally in May.
The UDD supporters laid wreaths and flowers around the Democracy Monument on Ratchadamnern Klang road to mark the fourth anniversary of the military coup which ousted former prime minister Thaksin Shinawatra four years ago.
The red-shirts also gathered at Ratchaprasong, waving flags and chanting loudly, while the police were ensuring that roads will remain open.
National police chief Wichean Potephosree, who met Prime Minister Abhisit Vejjajiva on Sunday morning to report the security situation, said the police will take legal action against the red-shirts if they break the law.
The gatherings must end before 8pm today, Pol Gen Wichean said.

Mass red shirt gatherings in key cities throughout the country have gone off without major incidents. The biggest turnout yesterday was reported at Bangkok’s Ratchaprasong intersection, the former focal point of the group during protests in April and May.
Large numbers of red shirt supporters led by the United Front for Democracy against Dictatorship turn up for a mass gathering at Ratchaprasong intersection to mark the fourth anniversary of the Sept 19, 2006 coup yesterday. It was their first major rally since they dispersed from the area on May 19. THITI WANNAMONTHA
Despite the day being free of incidents, the return of about 10,000 red shirts to Ratchaprasong has alarmed authorities that the anti-government movement could be regaining power.
Members of the United Front for Democracy against Dictatorship (UDD) converged in Bangkok and provinces considered red shirt strongholds: Chiang Mai, Phitsanulok, Phayao, Ubon Ratchathani, Ayutthaya, Rayong and Nakhon Si Thammarat.
The red shirts timed the gathering, the group’s strongest show of force since troops moved in to disperse their rally at Ratchaprasong on May 19, to coincide with the fourth anniversary of the Sept 19, 2006 coup that led to the ouster of Thaksin Shinawatra, seen as the UDD’s main supporter.
The UDD organisers said the gathering was meant to commemorate the 91 people, mostly red shirt protesters and security forces, who died in clashes between authorities and the anti-government group during the protests.
Security authorities were on the alert for civil unrest or sabotage by third parties, but the gatherings were mostly peaceful.
Department of Special Investigation director-general Tharit Pengdit said the UDD’s gathering yesterday was just one of the activities that the red shirts have planned. The DSI will closely monitor their movements, he said.
Mr Tharit said there had been no indication of money flowing in from abroad to fund yesterday’s gatherings.
Most activities yesterday followed a set pattern. Key UDD figures addressed the crowds, as members tied red banners at the venues. They then laid wreaths outside army installations before dispersing in the early evening.
Sombat Boonngam-anong, leader of the Red Sunday Group which arranged the Ratchaprasong gathering, said it was called off an hour early at 6.30pm because so many people had come and it was difficult to manage them without loudspeakers, which are banned under the emergency decree.
He said he was pleased with the turnout which brought traffic at Ratchaprasong intersection to a halt yesterday.
‘‘The roads were closed due to so many red shirts being there. The turnout was greater than I expected,’’ he said.
UDD supporters released red balloons over the intersection, lit candles and laid roses at the adjacent Pathum Wanaram temple where some of the group’s members were shot dead on May 19 by unidentified gunmen.
In Chiang Mai, UDD supporters ral lied at the Municipal Sports Stadium as 400 policemen stood by.
Red shirt supporters from northern provinces arrived at the stadium in the afternoon. Some also arrived by car from Bangkok.
An exhibition featuring information about the protest was set up and a play was staged mocking the military’s containment of the the Ratchaprasong protest.
In Phayao, a small group of UDD supporters wrapped red cloths around trees outside the provincial administration centre in Muang district. Most red shirts had left the province earlier to join the gathering in Chiang Mai.
In Phitsanulok, about 100 red shirt supporters picketed outside the Naresuan army camp. They tied balloons with messages written on them denouncing the military to the camp’s gate.
Meanwhile, the Interior Ministry held a rival gathering of 50,000 people in Udon Thani yesterday.
People from seven northeastern provinces in pink shirts gathered as part of a group they said was intended to protect the monarchy.
Mongkol Surasajja, chief of the provincial administration department, told the crowds on the grounds of Thung Sri Muang that their duty was to help forge national unity and honour the monarchy.
Interior Minister Chavarat Charnvirakul also took part in the event.
In Ubon Ratchathani, about 300 red shirt supporters met at Wat Thung Sri Muang and made merit for the victims of political violence.
A UDD member, who requested anonymity, said the members contacted one another by phone. No red shirt leaders were involved in arranging the gathering.
In Rayong, security guards refused to allow about 60 red shirt supporters tie banners near the gate of the provincial administration centre.
However, the guards retreated after the group threatened to push their way through.
In the South, Preeya Nakkaew, 70, mother of UDD core leader Natthawut Saikua thanked a crowd in Nakhon Si Thammarat for providing her son with moral support.
Mr Natthawut is among the key red shirt figures being detained at the Bangkok Special Prison on terrorism charges.
