# Huis kopen in Sri lanka

Hallo,

Hmmmm… Lastig gebied. Hoofdpunten:  
1] Je mag kopen maar betaalt 100% (!) extra property tax, dus 2 x zoveel als een local. Er zijn ‘uitwegen’ zoals local laten kopen en dan 99 jaar lease maar ze hebben allerlei valkuilen, wordt bijvoorbeeld niet erfbaar.  
2] Als je al koopt mag je er vervolgens niet wonen :beef: Nu ja, niet zomaar 12 maanden per jaar. Momenteel is 6 maanden redelijkerwijs haalbaar, tijdje terug was dat 3 maanden. Tenzij, tenzij, je een vrij fors vast inkomen laat opsturen (pensionado); zie [www.immigration.gov.lk](http://www.immigration.gov.lk) voor allerlei regels.  
3] Kopen is, hoe dan ook, een juridisch mijnenveld (niet alleen voor buitenlanders hoor). Het kadaster dekt misschien 30% van de vereiste info, om écht te bepalen of iemand recht heeft om jou land/huis te verkopen heb je een goede advocaat nodig en zeker 6 maanden doorlooptijd. Geldt ook voor gedeelde huizen zoals appartementencomplexen, aantal jaren terug bekeken we er eentje en onze (goede…) advocaat meldde na 2 weken zoeken dat alle huidige bewoners levensgrote kansen hadden op schadeclaims van een mede-eigenaar van het bouwland die destijds onterecht buiten de verkoop van het land aan de bouwer gelaten was :wereld:

Hallo

Niemand van de Buitenlanders kan een eigendom bezitten in Sri Lanka !  
Maar ook niet erven via leasing contract !cheer  
Ik woon nu in de Filipijnen waar ik een leasing contract heb voor 50 jaar op de grond !:zon02::slapen:  
Ik ben al in Kalutera geweest Mooi he !  
Sri lanka is mooier dan de Filipijnen !  
Ik hou veel van de sri lankezen !!!  
Spijtig Ieder land heeft zijn wetten .:mad:

bedankt voor je reactie

het is zover ik weet wel mogelijk om eigendom te bezitten in srilanka  
alleen moet je dan 100% belasting betalen  
dat maakt het wel erg duur  
ik heb daarom gekozen voor een lease van 99 jaar  
dat is trouwens sinds kort terug gebracht naar max 33 jaar  
dat het contract niet vererfbaar is dat is voor mij nieuw  
aangezien ik een testament heb die gewoon geregistreerd is bij het cadaster  
maar het jammere vind ik dat na de betaling en dergelijke de oude eigenaar niks anders dan een bak ellende maakt tegen mij  
ze proberen op de meest slinkse manier hun eigendom terug te krijgen  
daarin schuwen ze niks  
zelfs advokaten doen met drogen ogen mee aan deze criminele actie’s  
ik bedoel daarmee:  
falsheid in geschriften  
contract vervalsing  
corruptie die toch hoogtij viert  
en de ambasade doet doodleuk niets  
inmiddels eerste rechtzaak gewonnen  
de rechter vond het een belachelijke zaak en had er geen goed woord voor over  
maar de oude eigenaar gaat gewoon in hoger beroep  
terwijl alles tegen hun is wat bewijslast betrefd  
heb inmiddels beslag op al haar bezittingen laten leggen  
want de ervaring leert dat ze gewoon hun bezittingen op een andermans naam zetten waardoor je een kale kip overhou  
overal probeer ik hulp te vinden maar je staat er gewoon alleen voor  
daarom raad ik ten sterkste iedereen af ooit iets te kopen in srilanka  
zelfs lease is een wespen nest

wie kan mij hierin bijstaan?

**[Permanent Luxury: Buy a Property in Sri Lanka?](http://www.ceylonluxury.com/2009/08/permanent-luxury-buy-a-property-in-sri-lanka/)**

Once again we divert from the [central theme](http://www.ceylonluxury.com/about) of this blog to cover another topic of interest for you, our dear readers, when thinking of [luxury travel in Sri Lanka](http://www.ceylonluxury.com/category/luxury-travel): **real estate**.  
When visiting **Sri Lanka** , it may well be the case that you fall in love with the country- its _people_, [culture](http://www.ceylonluxury.com/category/culture) and _beauty_. And you might be tempted to set up a [holiday home](http://www.lankaholidays.com/) there, or who knows- even want to _retire_ there! Furthermore, we wouldn’t argue against the theory that [Sri Lanka ironically represents a lucrative investment](http://www.forbes.com/2009/08/21/sri-lanka-ceylon-civil-war-forbes-india.html) in these troubled financial times, given that the economy is emerging from a [twenty year civil war](http://www.ceylonluxury.com/2009/07/the-end-of-the-civil-war-in-sri-lanka/) and has been pretty well down and out for so long.  
If this is the case, **listen up** - as we have been through this process ourselves and learned a few things we’d like to share with you that you’re _unlikely_ to find on a real estate agent’s website…

The first thing you need to bear in mind when considering making any investment in a property in Sri Lanka is the words of the canny investor, [Warren Buffett](http://en.wikipedia.org/wiki/Warren_Buffett):  
“_Euphoria is an investor’s worst enemy; pessimism is his best friend_.”  
In other words, no matter **how good** a deal seems- think _twice_ and think _again_ after that. **Why**? Because **Sri Lanka** is _still_ the Wild West and if you think that you will have any legal recourse should things go awry, _forget it_. It’s all about finding people you can **trust** and establishing _transparency_ and _clarity_ in a business culture that is inherently **corrupt** and is going to stay that way for some time to come. Your _leverage_ is your **cash** and soon as you have given that over, you are very much _on your own_. So ask yourself what your motives are before jumping in the deep end, as if you’re looking for a solid investment that is _liquid_ and _safe_, this is **not** the place for you.  
However, if you’re able to _afford a bit of fun_ and want to add some **color** to your life without going bankrupt in the process…then **why not**? If you’re not putting _all your eggs_ in this particular basket and can afford it, you might even make some capital gain in the long-term. Having said this, please _do believe us_ when we give you some **tips** , as we ourselves have been down this road for better or worse!  
_Here are three **facts** on the ground that may help you:_  
\*\*\*\*\* If a foreigner buys land in **Sri Lanka** , there is a **100%** land tax. Obviously, this is completely prohibitive- but it can be gotten around by setting up a local company that owns the property, whereby you will own all the shares of this company. Bear in mind that this company will need to be “active” and so you’ll be bearing approx. **$1,000** in _legal_ and _accounting_ fees every year  
\*\*\* \*\*The real estate agents in Sri Lanka are **not** licensed or regulated. So any _Tom_, _Dick_ or _Harry_ can say that they’re an agent while having no qualifications or ability for you to hold to account. In addition, they take an extortionate **10%** commission of the sale- **5%** from the _buyer_ and **5%** from the _seller_. _ **Unbelievable** _, we hear you say and we _agree_!  
\*\*\* \*\*There is a weird _metric system_ in **Sri Lanka** when it comes to measuring land: perches. Prices will nearly always be quoted in terms of **Sri Lankan Rupees** _per perch_. **One** _perch_ is **25** _square meters_, so **160** _perches_ is \*\*one \*\*_acre_. Become familiar with this as quickly as possible.  
Our **advice** would be that you _resist_ all the amazing _deals of the century_ you find on your holiday and if you really are considering **buying a property** - come back and **rent** first. Learn the _lay of the land_ before you commit your hard-earned shekels to a fantasy. The only possible downside to this is that you miss the _gold rush_ and [Sri Lankan real estate](http://lankaestate.net/) suddenly is competing with **Manhattan** overnight. Talk to the [other expats](http://lanka-expats.net/) who have bought properties, **learn** from their _mistakes_ and **find** _contacts_ of people you can really, really **trust** via multiple and solid recommendations. Don’t forget- these will likely be your neighbors also, so be _smart_ and don’t go showing off! Otherwise, everyone will want a piece of you- **Sri Lanka** can become a small place _very_ quickly!!  
_So what do we suggest if you are interested in buying a property in Sri Lanka?_  
\*\*\*\*\*\* **Don’t rush** - [rent a house](http://lankaestate.net/ser_rental.php)for a year in the area that you are interested in buying a property in and **take your time** learning _what_ is _what_ & _who_ is _who_.  
\*\*\*\*\*\* Find **one single estate agent** that you like/trust and _negotiate_ a **lower commission** than **5%** from your end. For _buying_ or _renting_, we recommend **Sven** at **[LankaEstate.net](http://lankaestate.net/)**. With **Sven** (_don’t tell him we told you about negotiating on the commission!_), _what you see_ is _what you get_ and he is an **authentic professional** in this industry. And unlike many other agents, he won’t _abandon you_ after the purchase and will continue to help & look after you. There are a disproportionate amount of agents for such a small real estate market as **Sri Lanka** and many of them are foreigners who have been around for years supplementing their passive income. If you can pick one single agent, your life on the social front will be _much_ smoother!  
\*\*\*\*\*\* **Find** a \*\*trustworthy lawyer \*\*who will represent your best interests and not the seller’s. We recommend [**Bindu Wickramasekara**](http://www.pearlsrilanka.com/useful_contacts.html). A lawyer like **Bindu** will charge **2%** of the purchase price, but he will do so _much more_ for you than just legal searches, paperwork and the usual that one might expect in the West- he will be your _eyes_ and _ears_ on the ground and be able to help you see the _wood from the trees_…  
\*\* For **setting up your company** in **Sri Lanka** , there is only one law firm that can be recommended: **[Simon and Associates](http://www.simonlex.com/)** in **Colombo**. With **Simon** you are in the safest hands possible and sleep at night knowing that you are protected by the best. This is going to set you back approx. **$3,000**.  
\*\*\*\* \*\*For banking, by far the easiest to use is **[HSBC](http://www.hsbc.lk/1/2/commercial/banking-channels/list-of-branches)** in **Colombo**. At the minimum you will need to set up what is known as a **SIERA** account (_share investment external rupee account_).  
\*\*\*\*\*\* If you are buying a plot of land or an old property, get quotes from a **builder** who you have decided to use **before you buy** , and not _after_. As a rule of thumb, the cost of building in **Sri Lanka** with a high end finish is approx. **$400** – **$500** _per square meter_. So for a large house of **500 sqm** (_say 4 bedrooms, large living space, etc_)- that’s **$250,000**. Allow another **$50,000** for your landscaping, pool and other external costs and you’re talking about **$300,000** for building a beautiful house that is done to your specifications. Of course you will get cheaper quotes than this, but you already know where that will lead you… **disaster**. And add to this the _cost of the land_ you bought. Also, bear in mind that while one might assume otherwise, **renovation** can cost _as much_- if not _more_- than building from scratch with demolition, etc. Plus in many places (especially within [Galle Fort](http://www.fortgalle.com/)), you will need **building permits** for _any_ building or renovation work. We recommend **Neilan William** , owner of **[Siem Construction](http://www.kompass.com/en/LK005720)**. **Neilan** is a _rare breed_: an \*\*honest \*\*builder and as the owner of an \*established \*company with a _good reputation_, he can be trusted to stay **in budget** and **on schedule**.  
\*\*\*\*\*\* The [Sri Lankan currency](http://en.wikipedia.org/wiki/Sri_Lankan_rupee) is traditionally _weak_ against the _major world currencies_, so factor in some **depreciation** of the **SL Rupee**. You will find that the sellers will choose whatever currency suits them best _at the time_, but our advice is to stick to an offer in **USD** so that you know _exactly_ where you stand- whatever the volatility of the currency markets.  
\*\*\*\*\*\* Sri Lankan **sellers** are _always_ going to assume that _you_, as a foreigner, are very **wealthy** and will therefore try and achieve a selling price well **above market value**. You _must_ be prepared to _bargain hard_.  
\*\*\*\*\*\* _ **Now here is an idea for you** _…  
Maybe you can see from the above that buying property in \*\*Sri Lanka \*\*is **no picnic**. So instead of going through all the inevitable _emotional_ and _psychological_ turmoil of this torturous process, why not buy **someone else’s hard work** and effort _for a song_? By buying a property from an **expat** who is wanting to sell up for whatever reason (_leaving_, _fed up_, _cashing in on a gain_, _divorce_, _etc_…) you are going to avoid a lot of **hassle** and be able to buy the property as a company without all the _aggro_. _Yes_ you might be spending an _extra few dollars_ from what you’d pay a local for the property (\*and even that is debatable!), \*but trust us when we say that this is **money well spent**!

Ik heb niets gevonden op Sri Lanka Daar niemand kan eigendom bezitten !  
Maar heb een lease contract op de filipijnen de grond kan nooit op mijn naam staan maar wel het huis staat op mijn naam maar als mijn vrouw eerst sterft is het erftbaar dus de lot komt naar mij toe !

het is enorm lastig om een vertrouwd adres te vinden  
tis wat registratie betrefd een enorme chaos  
er geen cadaster zoals in nederland  
waar alles geregistreerd is  
de eigendoms papieren zijn soms van meerdere mensen  
en word het gesteggel of getouwtrek over de prijs  
de lease contracten zijn sinds vorig jaar max. 30 jaar  
het is al een behoorlijke opgave om een vertrouwelijke advokaat te vinden  
die de eigendoms papieren op juisthoud controleerd  
vaak is corruptie in het spel  
ik zou het niemand aanraden  
ben al 3 jaar met een rechtzaak bezig waar nog geen einde aan schijnt te komen.

Hallo allemaal,

Ik denk dat ik wel een weg weet die werkt, betrouwbaar is en helemaal legaal. Het is namelijk zo dat ik ongeveer 3 jaar zelf in Sri Lanka heb gewoont en nu getrouwd ben met Nisha, afkomstig uit Sri Lanka. In de jaren dat ik in Sri Lanka heb gewoont, merkte ik al dat het erg lastig is om als buitenlander een stuk land of huis te kopen, terwijl er veel te koop is en mensen best willen verkopen. Daar is een weg in te vinden. In het kort komt het erop neer dat jij jezelf neerzet als en lokaal bedrijf die land/huis willen kopen. In samenwerking met een notarissenkantoor koop je het land/huis. Jij betaalt, zij doen de aankoop en regelen de papieren. Na 6 maanden geeft het kantoor zijn aandelen aan jou en je bent 100% eigenaar, zonder belasting en zonder gedoe en compleet legaal. Wij hebben dit al eerder gedaan met mensen die een huis hebben gekocht in de buurt van Tangalle. Dit is heel soepel en in goed overleg verlopen. Het kantoor waarmee wij samenwerken staat goed aangeschreven en doen nu gemiddeld 3 x per week dit soort overdrachten.

Het klinkt als een optie, de zwakke schakel is dat je geen poot om op te staan hebt als het notariskantoor na 6 maanden plotseling dat bezit van de aandelen niet aan jou wil geven. Een juridische overeenkomst hiertoe kun je immers niet hebben, dan is er geen sprake meer van ‘geven’.

Tenzij je als buitenlander dat kantoor geheel vertrouwt zou ik hiermee dus even buitengewoon voorzichtig zijn als met alle andere Lankaanse OG-zaken. Gevallen van buitenlanders die een huis kochten via hun “beste vriend” en een paar maanden later letterlijk op straat gezet werden door diezelfde vriend omdat die daarna met de échte eigendomsakte van de grond kwam opdraven (en niet de akte die aan de buitenlander verkocht was) komen helaas net wat te vaak voor…

inderdaad erikdr  
dit is een zeer gevaarlijke manier om een huis te kopen  
want voor je het weet staan ze met de eigendoms papieren te wapperen  
en al je geld kwijt plus een zogenaamde vriend.  
ben nu getrouwd met een srilankaanse schone en we zijn nu bezig het lease contract om te zetten naar eigendom, en dan op haar naam.

had ook een vriend waar ik samen een stuk grond gekocht had  
op zijn naam, binnen een maand had hij het verkocht bij een pandjes baas  
geld weg  
vriend met vliegtuig met de noorder zon vertrokken.

heb nu met mijn vrouw afgesproken  
wij lenen aan niemand geld uit  
want ik verlies liever een vriend , dan een vriend en mijn geld  
want wat gebeurt er vaak  
je leent iemand geld, ze maken dan enorme ruzie met je  
wat betekend , dat je uiteindelijk je geld en vriend kwijt ben

echt mensen, vertrouw niemand  
vind het jammer om op deze manier te waarschuwen  
zelfs advokaten zijn niet te vertrouwen  
terwijl die wel de wet horen te vertegenwoordigen  
ik kan hier inmiddels een boek over schrijven  
die echt heel negatief zal zijn over de handel en wandel in srilanka

24 augustus a.s. weer echtzaak  
want de oude eigenaar heeft 2 keer rechtzaak verloren  
maar ze gaan gewoon weer in hoger beroep  
en dit zal net zo lang doorgaan  
tot je het gewoon opgeef  
helaas hebben ze aan mijn vrouw en aan mij een verkeerde  
het hele land stinkt gewoon van de corruptie

advokaten die achter je rug om een dealtje sluiten met de tegenpartij  
en dan weer met een rekening komen dat het wat duurder uitvalt

wat de politiek betrefd:  
1 grote familie kliek  
negatieve schrijvers verdwijnen, en worden vermoord  
oorlogs misdaden  
ect ect

Het is inderdaad moeilijk om mensen te vinden die willen helpen zonder eigenbelang. Ik lees de woorden ‘corruptie’ en ‘niemand vertrouwen’. Dit is ook inderdaad het geval als je geen netwerk van jaren hebt opgebouwt. De weg vinden is dan erg moeilijk. Daarom willen wij juist dit aanbieden aan mensen die willen genieten van een mooi en rustig verblijf op Sri Lanka. Wij hebben dit netwerk wel en kunnen garanderen dat het zo verloopt als is afgesproken. Via deze weg hebben wij al diverse mensen geholpen aan een huis of stuk land. Tot op heden zijn alle transacties geslaagd en is iedereen tevreden met de gang van zaken. Eventuele referenties zijn te bellen om hun verhaal en ervaringen te horen.  
En ja, je moet goed uitkijken met wie je zaken doet. Daarom moet je zeker geen stappen zetten als je er geen vertrouwen in hebt. Mocht je meer infomatie willen hoe wij dit aanpakken, met wie wij samenwerken of contact willen met mensen die eerder deze weg hebben bewandeld, laat het dan weten.

Ik leef niet in Sri Lanka maar ben drie keren geweest !  
Ik woon nu op de Filipijnen hier kan ook niemand van de buitenlanders grond bezitten alleen lease !
